My manager threatened to give me a bad reference if I quit

I was about to quit my job and get a new job, and my manager got angry and said he was going to badmouth me to my new employer. Is this legal?

Wow! What a charming manager!

I’m Jeff Altman, big game hunter. I coach employees and organizations on how to recruit more effectively, perform better in job searches, manage and lead more effectively, and a host of different things related to being effective in the workplace. Get this situation.

I was about to quit my job and get a new job, and my manager got angry and said he was going to badmouth me to my new employer. Is this legal? Wow! You’re working for a very special person, aren’t you? Here are my thoughts. When you give notice to your boss and put it in writing, you look at them and I want to start with an assumption.

Our assumption is that they have no reason to provide false references and that you are smart enough that you would go find someone else to provide references if their threats were true. So, taking that as a premise, we want to challenge your boss once, so to speak, and just briefly, I have a friend who is a lawyer and I just want to be clear. If you act on this threat, I will own your house.

It will take time, but if you lose my job because you want to keep me there, I will own your house and more stuff and your company will fire you because of the fact that you opened them up to a lawsuit. So, it’s your choice. I don’t want to do it, but when you threaten my livelihood in this way, I have to respond and get out of there.

So, tell me what are you going to do? Now, you couldn’t be more direct than that, and you mean it. You would sue them and sue him personally for making such a threat beforehand. So, this is one way to solve this problem.

Alternatively, when it’s time to give notice, you walk into the HR office instead of walking into his or her office. We don’t know the gender, you tell HR, I will notify you today. I will leave on such and such date.

I want to clarify something. I could have done this with my manager, but he made threats that he would give bad references. He did this to make sure I wouldn’t take the job.

I also want to clarify that if he takes action, I will take legal action. I would appreciate it if you could talk to him to make sure we don’t have to meet in court. This should put an end to the nonsense.

People like this will try to bully people with lower prices, less experienced people, and you don’t want to be bullied. You want to get as far away from this person as possible. Leaving is a good option because if this is how you act when they think you’re leaving, I can only imagine what it’s like when you work there.
