Litigation demands for meetings without consent

Transcription tool Otter AI has long had an “assistant” service to transcribe video conferencing. “Otter NoteTaker” can go to Zoom, Google Meet or Microsoft team to make calls and record what participants say in real time. Now, a class action lawsuit filed Friday claims that Otter’s deadly people not only record people who want to record, but also those who have not subscribed to its services or agree to be recorded.
Not only that, the lawsuit states that Otter did not disclose to those who set up Otter NoteTaker that the transcripts were used to train Otter’s automatic speech recognition and machine learning models.

California resident Justin Brewer filed the lawsuit on behalf of himself and other Californians and Americans, saying the Otter intercepted his conversation. The lawsuit claims that the otter violates federal and California laws, such as the Electronic Communications Privacy Act of 1986 and the California Invasion Privacy Act.
Mixable light speed
The lawsuit noted that Brewer did not have an Otter account but attended a Zoom conference using Otter NoteTaker in February. He didn’t know that Otter would acquire and retain that data, nor did he notify the service that it would use this data to train its speech recognition and machine learning tools. The lawsuit says Brewer disagrees with this, “if his privacy is severely compromised and affected by the risks and harmful conditions posed by the otter’s violation of federal and California laws.”
Otter’s privacy policy states that it trains its AI technology in “unidentified” recordings. It also said it had obtained a clear permission to access the conversation for training, but the lawsuit claimed that Otter Notetaker requested agreement to join and record the meeting host’s meeting (if the host does not have an Otter account). According to the document, it does not require attendance of any other participant meeting, nor does it allow anyone other than the meeting host to disable Otter Notetaker.
